There is no requirement that a married spouse also needs to file for bankruptcy. However, the spouse may want to file for bankruptcy if the spouse is also liable on the debts.
The other issue is that when calculating whether or not you qualify to file under the means test, your spouse’s income is factored into the calculation, even if your spouse isn’t filing bankruptcy with you.
